1.Having gone through the entire case for the prosecution and the evidence, I have come to a conclusion that a prima facie case has been established which requires me to call upon the defendant herein, which I hereby do, to make his defence as required under section 211 CPC.
2.Meanwhile let me warn all those who are fond of making remarks on the outcome of the matter desiring to have 'Nyandoto afungwe kabisa' to stop forthwith. The outcome of this case will depend on the evidence adduced in court and during the trial herein which is still on. Anyone interested is still at liberty to meet with the prosecutions so as to have his evidence received.
3.Let me remind all that the mandate of the Judiciary is guided by the principles derived from Article 159 (2) of the Constitution:-(a)justice shall be done to all, irrespective of status;(b)justice shall not be delayed;(c)alternative forms of dispute resolution including reconciliation,mediation, arbitration and traditional dispute resolution mechanisms shall be promoted, subject to clause (3);(d)justice shall be administered without undue regard to procedural technicalities; and(e)the purpose and principles of this Constitution shall be protected and promoted.
