1.In her application dated 20th May 2025 the Applicant prays for orders that:-(a)The grant of letters of administration made to Peter Kahoro Mungai and Muthoni Nganga on 15th March 2023 be fully confirmed and Plot Number 1513 Mwiriukia be transmitted to Beth Muthoni Nganga.(b)Costs be provided for.
2.The application is based on the Applicant’s affidavit of even date.
3.The application is based on the fact that vide the consent of the parties dated 24th January 2024 all the estate properties were distributed save for the above Mwiriukia property.
4.The parties had agreed that they were to agree on the same and if not, the court was to make a determination.
5.From the Applicants supporting affidavit there is sufficient documentary evidence that her counsel called for a meeting twice but there was no corporation from the Respondent.
6.At the same time there is no evidence on record of any response to her application.
7.In the premises this court has no option but to allow the application. Litigation must come to an end. There is no evidence that the Applicant benefited from another property of the estate as insinuated by the Respondent.
8.In the premises the application is allowed as prayed with costs to the Applicant.
