1.The Applicant Edwin Shisanya is an Advocate of the High Court of Kenya, who trades as Shisanya & Co. Advocates. He has filed this Application dated 18th July 2025, pursuant to the Section 51 (2) of the Advocates Act (Cap 16 Laws of Kenya). The Application, which is supported by the Supporting Affidavit of the said Advocate, seeks judgment to be entered against the Client/Respondent for the sum of Ksh 343,612/80. Being taxed Advocates-Client costs as per a Certificate of Taxation issued by Hon Silvia Motari, Taxing Officer, on 15th October 2024.
2.The Application was not opposed, despite it having been duly served on the Respondent, as per the Affidavit of service on record.
Determination
3.I have perused the Application, its Supporting Affidavit, as well as the said Certificate of Taxation. The said certificate being valid, it not having been set aside, and retainer/instructions not having been disputed, the Application is hereby allowed, and judgment is hereby entered for the Applicant/Advocate against his Client the Respondent, for said sum of Ksh 343, 612/80, as per the said Certificate of Taxation. A copy of which certificate was annexed to the Supporting Affidavit as Annexture “ES-1”. A decree shall issue for that sum.
4.The Applicant is hereby also awarded the costs of this Application. Which costs are hereby assessed at Ksh10, 000=.
