RULING.

The 3 accused persons Hellen Anyango oloo (Accused1), Julius Otieno Syonge (Accused 2) and Pamela Atieno Ramogi (accused 3) are charged with murder C/Section 203 as read withS. 204 of the Penal Code in that on 10.7.2012 at Ohuro Village, Kamdar Kawanga Sub Location in Ndhiwa District within Homa Bay County jointly with others not before court murdered Joseph Alal Ramogi.

They pleaded not guilty to the charge and their trial commenced on 25.3.2013 through their lawyer, Mr. Ojala, they applied to be released on bond pending conclusion of their trial. Miss Valery the learned advocate for the state intimated that she had no compelling reasons for the accused persons not to be released.

That being the position the accused persons application for bond is granted on the following terms:-

1.      That each of them shall execute a bond of Kshs.3 million with 2 substantial sureties of similar amount.

2.      The sureties to be examined and approved by the Deputy Registrar.

3.      That pending the trial the accused persons shall attend court at least once a month.

4.      Hearing on 16.4.2013.
