1.The Nairobi County and Land Use Planning Liaison Committee pursuant to provisions of Section 80(2) of the Physical and Land Use Planning Act, 2019 heard the above appeal No. NCCG/PLUPLC/E004 of 2024 filed on 15/2/2024 and vide minute 2/29/2/24 dated 29/2/2024 the committee made a determination as follows:-
1.The appellants Advocate confirmed to the Committee that he had filed a Notice of Withdrawal dated 29/2/2024 seeking to withdraw the appeal.
2.The appellants had not served the County Authorities.
3.The Notice of Withdrawal relied upon provided that the appellant was a tenant at the premises and has since vacated.
Determinationa.The Appeal is hereby withdrawn.b.The Enforcement Notice 31/1/2024 remains valid.c.The County Attorney to advise the County accordingly.
