1. Citation

These Regulations may be cited as the Wildlife Conservation and Management (Access and Conservation) (Fees) Regulations 2023.

2. Application

These Regulations shall apply to the accessing and conservation of national parks, national reserves and sanctuaries.

3. Interpretation

In these Regulations unless the context otherwise requires—"African citizen" means a national of any other African country other than an East African citizen;"child" means a person who has not attained the age of eighteen years;"commercial vehicle" has the same meaning as assigned to it under section 2 of the Traffic Act (Cap. 403);"corporate pass" means to access rights issued to eligible utility providers having installations within national parks, national reserves and sanctuaries;"daily fee" means the fee paid for a single continuous entry to a national park, national reserve or sanctuary and which shall be valid for a period not exceeding twenty-four hours;"disability" has the same meaning as assigned to it under section 2 of the Persons with Disabilities Act, 2003;"East African citizen" means a national of any of the partner states in the East African Community established under Article 2 of the Treaty for the Establishment of the East African Community;"high season" means the period between the 1st July of one year and the 31st March of the following year:Provided that for activities undertaken Mt. Kenya national park, national reserve or sanctuary, "high season" means the period between—
(a)the 1st July in one year and the 30th September of the same year; and
(b)the 1st December of one year and the 29th February of the following year;
"low season" means the period between the 1st April of one year and the 30th June of the following year:Provided that for the Mt. Kenya national park, national reserve or sanctuary, "high season" means the period between—
(a)the 1st October in one year and the 30th November of the same year; and
(b)the 1st March of one year and the 30th June of the same year;
"marine park" means a park in aquatic environments dedicated in conserving and managing marine ecosystem including coral reefs, seagrass beds and underwater canyons;"mountain parks" means a park within mountain regions which preserve pristine alpine meadows, forests, lakes and peaks;"micro enterprise" has the meaning assigned to it under section 2 of the Micro and Small Enterprises Act;"non-resident" means a national of any country other than an East African citizen or African citizen;"premium parks" means a park that offer exceptional quality, superior amenities, exclusive tourism experience, which command higher fees and limited crowd size to maintain ecological integrity and an exceptional visitors experience;"resident" means a person, other than a Kenyan citizen or an East African citizen, residing in Kenya;"scenic park" means a park known for their exceptional beauty and breathtaking landscapes which emphasize the preservation of stunning natural scene such as mountain ranges, waterfalls and dramatic viewpoints;"senior citizen" means a Kenyan citizen who is of or above the age of seventy years; and"special interest park" means a park that offer adventure and thrilled based recreational facilities within a controlled and safe environment;"student" refers to an individual from a recognized secondary, government or private college or university who is not older than twenty-three years visiting a national park, national reserve or sanctuary for educational purposes under a documented and organised arrangement with that educational institution but excludes students on personally-arranged visits;"urban park" means a parks located within the cities and urban areas which offer green spaces and recreational attraction in densely populated areas hence promoting relaxation, physical activities and social attraction; and"wilderness parks" means a park primarily designated for the conservation and preservation of pristine, unspoiled natural landscape and ecosystems so as to allow visitors experience raw and unaltered natural world while minimising human disruption.

4. Identification of users

Any person seeking to enter into, access or undertake activities in a national park, national reserve and sanctuary shall provide the following identification documents—
(a)a Kenyan citizen shall provide a valid identification document;
(b)an East Africa citizen shall provide a valid passport;
(c)an African citizen shall provide a valid passport;
(d)a resident shall provide appropriate documentation from the Kenyan government evidencing their residency;
(e)a non-resident shall provide a valid passport;
(f)a person with disability shall provide valid documentation from the National Council for Persons with Disabilities; and
(g)a student shall provide a valid student identity card.

5. Categorisation of parks, reserves and sanctuaries

For purposes of these Regulations, national parks, national reserves and sanctuaries shall be categorised into the following—
(a)marine parks;
(b)mountain parks;
(c)premium parks;
(d)scenic parks;
(e)special interest parks;
(f)urban safari;
(g)wilderness parks; and
(h)sanctuaries.

6. Conservation fees

(1)The fees payable to the Kenya Wildlife Service for entry into, access and conservation of national parks, national reserves and sanctuaries shall be as set out in the Schedule.
(2)The fees payable under paragraph (1) in respect of a student or a child above the age of five years but below eighteen years shall be as set out in the Schedule.

7. Special activity fees

(1)The fees payable to the Kenya Wildlife Service for special activities in national parks, national reserves and sanctuaries shall be as set out in the Schedule.
(2)The special activity fee payable under paragraph (1) shall not include fees payable for entry into a national park, national reserve or sanctuary.

8. Security fee

(1)The fees payable to the Kenya Wildlife Service for safety and security provided to a visitor in national parks, national reserves and sanctuaries shall be as set out in the Schedule.
(2)The security fee payable under paragraph (1) shall be in respect of one section of ranger and applicable to any event site after 6:30 p.m.

9. Annual pass

The annual fees payable to the Kenya Wildlife Service for access to national parks, national reserves and sanctuaries shall be at the rate specified in the Schedule.

10. Corporate pass

The fees payable to the Kenya Wildlife Service for a corporate pass in respect of a national park, national reserve and sanctuaries shall be as set out in the Schedule.

11. Exemption from fees

A senior citizen, a person with disability or a child below age of five years shall be exempted from paying fees in respect of access or entry into a national park, a national reserve or sanctuary:Provided the senior citizen, person with disability or child provides the relevant identification document required under regulation 4.

12. Revocation of L.N. 150/2023

The Wildlife Conservation and Management (Access and Conservation) (Fees) Regulations 2023 are revoked.
