Directions
1.The court has perused the two applications for confirmation of grants dated 28th September 2023 and 17th July 2024 respectively together with the supporting affidavits.
2.The court has also perused the submissions filed in support and or in opposition to the said applications.
3.The court is however unable to make a comprehensive and meaningful distribution of the estate due to serious divergence of views contained in the pleadings. At the same time there are averments that there are creditors to the estate which I think it will be prudent to have a proper adduction of oral evidence to back up the allegations.
4.I state so because this matter has had a long history since 2004 and the best approach is to hear the parties orally on one question, namely, how they wish the estate to be distributed.
5.Consequently, let the parties take an appropriate date where they will attend court and orally support how the estate ought to be distributed before the court renders its final verdict.
