Ruling
1.Davis Gitonga Karani petitions this court for a grant of letters of Administration Ad-litem of the Estate of Karani Njirigu Korabu who died domiciled in Nyahururu on 12th May, 2022 limited for purposes of filing suit against intermeddlers of the Estate and/or join a suit filed at Nyandarua High Court Commercial Suit No. E001 of 2023, Grace Wanjiku Karani v Karson Motor Engineering Limited & Others as a Co-Plaintiff against intermeddlers.
2.Further, he avers that he intends to join a suit filed at Nyandarua High Court Commercial Suit No. E001 of 2023 Grace Wanjiku Karani v Karson Motor Engineering Ltd & Others as a Co-Plaintiff, against intermeddlers of the property of the deceased who illegally transferred 99 shares belonging to the deceased in Karson Motor Engineering Ltd without following the due process in law to themselves which transfers have been done after the death of the deceased.
3.In support of the petition the Petitioner swore an affidavit where he avers that he would like to be enjoined in the suit as a Co-Plaintiff to preserve the Estate of the deceased from wastage pending institution of succession proceedings. That the deceased was polygamous with two (2) houses and the intermeddlers are from the 1st house who have illegally and fraudulently transferred the shares after the death of the deceased.
4.The application is supported by an affidavit with annexures being; a death certificate in respect of the deceased, a letter from the Chief that was authored when the Petitioner’s mother sought letters of Administration Ad-Litem to institute the suit that the Petitioner is seeking to be enjoined confirming his relationship with the deceased amongst other summons and a consent signed by his biological siblings.
5.The deceased herein died on 12th May, 2022. Three (3) years downline the court has not been told why a substantive grant has not been sought in respect of the Estate of the deceased. Action required follows the argument that there has been intermeddling with the Estate of the deceased, in particular, shares in Karson Motor Engineering Ltd that belonged to the deceased.
6.A limited grant of letters of Administration Ad-Litem was issued to Grace Wanjiku Karani on 25th May, 2022, the mother of the Petitioner, who avers that she is elderly and she has signed a written consent to the Petitioner being granted the letters of Administration Ad-Litem.
7.What has been established is the risk of the Estate of the deceased being intermeddled with. There is hence need to protect the same by the matter in court being heard and determined.
8.In the premises I find the application having merit. Therefore, I grant the Petitioner letters of Administration intestate Ad-litem limited to making an application to be enjoined as a party in High Court Commercial Suit No. E001 of 2023 so as to participate in proceedings thereof.
9.It is so ordered.
