1.This is an application for stay pending appeal which was made within a reasonable time (around one month after issuance of a decree). The Court granted a conditional stay upon a deposit of a decretal amount. The right of appeal is constitutional and not discretional like a grant of stay. Having ordered that the Decretal amount is deposited, the interest of both parties are safeguarded. The Application is allowed as prayed. If in any chance the conditional stay has not been met, execution to follow during the pendency of this appeal. For clarification purposes, the Appeal may proceed despite execution. The Respondent shall have costs.
