Ouma v Republic (Criminal Revision E153 of 2024) [2024] KEHC 16459 (KLR) (30 December 2024) (Ruling)

1.The convict Richard Ouma Ouma was sentenced to serve one and a half years for the offence of being found in possession of narcotics contrary to section 3(1) as read with section 3(2) of the Narcotic Drugs and Psychotropic Substances Control Act on 31st October, 2023. He has been in jail since then and now served one year and two months imprisonment.
2.He however had a pending robbery with violence case being Kisumu CM Cr. Case No. E780 of 2022.
3.For the above reason that the fate of the robbery with violence case against him is not known, I decline to exercise any discretion on the lawful sentence imposed.
4.The request for sentence review is declined and dismissed.
