Ruling
1.The court has reviewed and considered the application dated 29th July, 2025 brought under certificate of urgency. The court has further considered the affidavit in support of the application and considered it harmless in granting the same as no prejudice would be occasioned to the respondent if the same is granted.
2.Leave is hereby granted to the appellant to appeal out of time. The intended appeal be filed and served within 30 days of this order.
3.The sum of Kshs. 4,000,000/- deposited as a condition for stay of execution in regard to MCELRC No. 625 of 2021 to become security in respect of the intended appeal.
4.Costs to abide the outcome of the appeal.
