Ruling
1.Jared Danvas Bosire, the applicant herein was, charged, tried and convicted of the defilement contrary to section 8(1) as read with section8(2) of the Sexual Offences Act. He was sentenced to serve forty (40) years imprisonment. His appeal to the High Court sitting at Kisii was dismissed on 23rd August, 2022. The applicant wishes to appeal against the said decision to this Court in the exercise of his right to second appeal. He has therefore made an application essentially under Rule 4 of the Court of Appeal Rules to be granted leave to appeal out of time.The application is not opposed by the Director of Public Prosecutions.
2.In the premises therefore, the application has merit. The applicant is granted leave to appeal out of time. He shall file and serve the notice of appeal within fourteen (14) days of today’s date.
