Order
The dispute between the parties is one of rent. The rent “owing or not owing” clearly being contested, justice will be better served by allowing the Tenant’s Application in terms of prayer 3 thereof. I further order that the Tenant will continue paying rent to the Landlord and if the Landlord declines the rent, the Tenant will be at liberty to move the court appropriately.
