THE PRIVILEGES AND IMMUNITIES (OXFAM INTERNATIONAL) ORDER

LEGAL NOTICE 63 OF 2024

1. This Order may be cited as the Privileges And Immunities (Oxfam International) Order.2. Oxfam International, in this Order referred to as the “Agency”, being a foundation with which the Government of Kenya has entered into an agreement for co-operation is declared to be an agency to which section 11 of the Act shall apply.3. The Agency shall have the privileges and immunities specified in Part I of the Fourth Schedule to the Act.4. Despite paragraph 3—
(a)immunity from legal processes shall not apply in the case of commercial disputes, labour disputes or where disputes have been waived by the Agency;
(b)tax exemption shall not extend to—
(i)levies and user charges;
(ii)goods that are directly imported for the official use of the Agency in Kenya and sold in the Republic of Kenya to a person or organisation that is not similarly privileged; or
(iii)the owner or lessor of any property rented by the Agency;
5. Any person who is an official of the Agency shall, while sojourning to, through and from Kenya and performing duties in the service of the Agency, have the privileges and immunities specified in paragraphs 3, 4 and 5 of Part III of the Fourth Schedule to the Act.6. Paragraph 5 shall not apply to a citizen of Kenya or to any person who is ordinarily resident in Kenya except solely for the purpose of being an employee of, and working exclusively for the Agency.
