1. Citation
This Order may be cited as the National Cereals and Produce Board (Vesting) Order, 2024.2. Interpretation
In this Order, unless the context otherwise requires—“liability” means any court case, debt, charge, duty or obligation arising from past or existing project contracts of every description and whether present or future, actual or contingent, and whether payable or to be observed or performed in Kenya or elsewhere;“National Cereals and Produce Board” means the National Cereals and Produce Board established under section 3 of the National Cereals and Produce Board Act (Cap. 338); and“vesting date” means the date this Order comes into force.3. Transfer and vesting
Notwithstanding anything contained in any other written law, the property set out in the Schedule and vested in the Cabinet Secretary to the National Treasury of Kenya or otherwise existing before the vesting date shall, with effect from the vesting date, be deemed to have been transferred to, vested in, imposed on, or be enforceable against the National Cereals and Produce Board.4. Vesting of rights and liabilities
Subject to this Order, any right, obligation or liability in respect of any property set out in the Schedule shall, with effect from the vesting date, be deemed to have been transferred to, vested in, imposed on, or been forceable against the National Cereals and Produce Board.5. Any reference to the Cabinet Secretary to the National Treasury of Kenya
Any reference to the Cabinet Secretary to the National Treasury of Kenya in any agreement, document or instrument entered into by the Cabinet Secretary to the National Treasury of Kenya in trust, on behalf of, or for the benefit of the National Cereals and Produce Board, with respect to the property set out in the Schedule, shall be deemed to be a reference to the National Cereals and Produce Board.6. Legal proceedings, etc.
Any proceedings, including legal and arbitration proceedings, taken by or against the Cabinet Secretary to the National Treasury of Kenya with respect to the property set out in the Schedule on or before the vesting date that remain uncompleted on the vesting date, shall be deemed to be proceedings taken by or against the National Cereals and Produce Board and any judgment or award obtained by or against the Cabinet Secretary to the National Treasury of Kenya and not fully satisfied on or before the vesting date shall be deemed to be a judgment or award obtained by or against the National Cereals and Produce Board.7. Licences, rights and permits
Any licence, right or permit issued or granted to the Cabinet Secretary to the National Treasury of Kenya with respect to any property set out in the Schedule which is in force on or before the vesting date shall remain in force for its unexpired period as if it had been issued or granted to the National Cereals and Produce Board.8. Savings and transition
Nothing in this Order shall terminate, discharge, invalidate or prejudicially affect any liability, obligation, right, security or undertaking of the Cabinet Secretary to the National Treasury of Kenya with respect to any property set out in the Schedule solely on account of the transfer or vesting under this Order.History of this document
