1.This Order may be cited as the Privileges and Immunities (PTA Reinsurance Company (ZEP-RE)) Order.
2.The PTA Reinsurance Company (ZEP RE) in this Order referred to as “the Company”, being a regional reinsurance company established in 1990 under an agreement subscribed to by the Government of Kenya and other Governments, is hereby declared to be an organization to which section 9 of the Act shall apply.
3.The Company shall have the legal capacity of a body corporate to—
(a)enter into contracts;
(b)institute and defend legal proceedings; and
(c)acquire, hold or dispose of movable and immovable property in accordance with the laws of the Republic of Kenya.
4.The Company shall have the privileges and immunities set out in Part I of the Fourth Schedule to the Act.
5.The director, officials and staff of the Company shall, while residing in Kenya and performing duties in the service of the Organization, have the privileges and immunities set out in Part III of the Fourth Schedule to the Act:Provided that the provisions of this paragraph shall not apply to a citizen of Kenya who is locally recruited as a director, official or staff of the company.
