IN EXERCISE of the powers conferred by section 42 (1) of the Competition Act, 2010, the Competition Authority of Kenya excludes the proposed transfer from the provisions of Part IV of the Act due to the following reasons—
(a)the transaction will not affect competition negatively;
(b)the parties have no turnover for the preceeding year 2015; and
(c)the transaction is below the merger threshold required for mandatory notification as contained in the Merger Threshold Guidelines.
