IN EXERCISE of the powers conferred by section 42 (1) of the Competition Act, 2010, the Competition Authority of Kenya excludes the proposed acquisition of 50% of the entire issued share capital of WS Atkins PLC by SNC-Lavalin Group INC from the provisions of Part IV of the Act due to the following reasons—
(a)the transaction will not affect competition negatively;
(b)the acquirer's had no turnover for the preceeding year 2015 while the target's turnover was KES 614,236,000; and
(c)the transaction is below the merger threshold required for mandatory notification as contained in the Merger Threshold Guidelines.
