1.These Order may be cited as the privileges and Immunities (Africa Capacity Building Foundation) Order.
2.The Africa Capacity Building Foundation, in this Order referred to as "the Foundation", being a capacity building foundation established by a Protocol subscribed to by the Government of Kenya and other govemments, is declared to be an organization to which section 9 of the Act shall apply.
3.The Foundation shall-
(a)be a body corporate; and
(b)have the privileges and immunities specified in paragraphs 2, 3 and 4 of Part I of the Fourth Schedule to the Act.
4.The Regional Director and Internationally recruited staff members of the Foundation shall, while residing in Kenya and performing duties in the service of the Foundation, have the privileges specified in paragraphs 2, 3, 4, 6 and 7 of Part III of the Fourth Schedule to the Act:Provided that the provisions of this paragraph shall not apply to citizens of Kenya or to any person who is ordinarily resident in Kenya except solely for the purpose of being an employee of, or lvorking exclusively for, the Foundation.
