1.This Order may be cited as the Value Added Tax (Remission) Order.
2.The tax payable on the items listed in the Schedule hereto being imported for the Kwale Titanium Mining project by Tiomin Kenya Limited within the year 2007 be remitted wholly:Provided that the tax remitted by this Order shall be payable by Tiomin Kenya Limited in the event that the Cabinet Secretary determines that Tiomin Kenya Limited is in breach of any of the terms of the Agreement in relation to a Special Mining Lease granted by the Government of Kenya to Tiomin Resources Inc. et al entered on 2nd February, 2005.
