IN EXERCISE of the powers conferred by section 119 (1) of the Traffic Act, the Minister for Transport and Communications makes the following Rules:—

THE TRAFFIC (MOVEMENT) RULES, 1985

1.

These Rules may be cited as the Traffic (Movement) Rules, 1985.

2.

In these Rules, "agricultural produce" has the meaning assigned to that term by the Agricultural Produce Marketing Act.

(1)No commercial vehicle having a tare weight of 3 tonnes or over shall, while carrying agricultural produce, be driven on any road between 6 p.m. and 6 a.m.
(2)Where any vehicle is driven on a road in contravention of this rule the driver and the owner shall each be guilty of an offence and liable—
(a)in The case of a first offence, to a fine not exceeding two thousand shillings or to imprisonment for a term not exceeding three months or both;
(b)in case of a second or subsequent offence, to a fine not exceeding five thousand shillings or to imprisonment for a term not exceeding six months or both.

3A.

These Rules shall not apply to vehicles carrying goods which, if prevented from moving between the hours of 6 p.m. and 6 a.m., will perish or deteriorate.

4.

The Traffic (Movement) Rules [L.N. 56 of 1982] are revoked.
